Privacy Policy Pursuant to Article 13 of Regulation (EU) 2016/679


PREAMBLE

AF SYSTEM S.R.L., with registered office in Via Landini 76, 21050 Marnate (VA), Tel. +39 0331 365239, Tax Code/VAT No. 03562540124, as the data controller pursuant to EU Regulation 679/2016 applicable from May 25, 2018 – the General Data Protection Regulation (“GDPR”) – and the applicable national legislation (hereinafter collectively referred to as the “Applicable Law”), recognizes the importance of protecting personal data and considers their safeguarding as one of the main objectives of its business activities.

Before providing any personal data, AF SYSTEM S.R.L. invites you, as a user of the website, to carefully read this Privacy Policy, as it contains important information about the protection of personal data and the security measures adopted to ensure confidentiality in full compliance with the Applicable Law.

This Privacy Policy:

  • applies exclusively to the website https://www.af-system.it/ and not to other websites that may be accessed via external links;
  • constitutes an information notice provided pursuant to the Applicable Law to those who interact with the website;
  • complies with Recommendation No. 2/2001 concerning the minimum requirements for the collection of data online within the European Union, adopted on May 17, 2001, by the Article 29 Working Party.

AF SYSTEM S.R.L. informs that the processing of personal data will be based on the principles of lawfulness, fairness, transparency, purpose limitation, storage limitation, data minimization, accuracy, integrity, and confidentiality. Personal data will therefore be processed in accordance with the legislative provisions of the Applicable Law and the confidentiality obligations therein provided.

1. DATA CONTROLLER

Pursuant to the Applicable Law, the Data Controller of personal data processed through the Website is AF SYSTEM S.R.L.

 

2. PERSONAL DATA SUBJECT TO PROCESSING

“Personal Data” means any information relating to an identified or identifiable natural person, with particular reference to an identifier such as a name, identification number, location data, online identifier, or one or more factors specific to the physical, physiological, mental, economic, cultural, or social identity of that person.

In particular, the Personal Data collected through the Website are as follows:

a. Browsing Data

The computer systems and software procedures used to operate this website acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols.
This information is not collected to be associated with identified individuals, but, by its very nature, could allow users to be identified through processing and association with data held by third parties.
This category of data includes IP addresses or domain names of the computers used by users connecting to the site, URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the server response (successful, error, etc.), and other parameters relating to the user’s operating system and IT environment.
These data are used solely to obtain anonymous statistical information about the use of the site, to check its proper functioning, to allow the correct provision of the various functionalities requested by the user, for security reasons, and to ascertain liability in case of computer crimes against the site or third parties.

b. Data Voluntarily Provided by the User

Through the Website, users may voluntarily provide Personal Data such as their name and e-mail address in order to contact the Controller via the contact form.
AF SYSTEM S.R.L. will process these data in compliance with the Applicable Law, assuming they refer to the user or to third parties who have expressly authorized the user to provide them.
In such cases, the user acts as an independent data controller, assuming all legal obligations and responsibilities. The user therefore releases AF SYSTEM S.R.L. from any liability for any dispute, claim, or request for compensation for damages arising from the processing of Personal Data provided in violation of the Applicable Law.

  1. PURPOSES, LEGAL BASIS, AND MANDATORY OR OPTIONAL NATURE OF THE PROCESSING

The Personal Data provided by the user will be processed by AF SYSTEM S.R.L. for the following purposes:

  • to register on the website;
  • to enable the use of services reserved for registered users accessible from the restricted area of the website;
  • for purposes related to the execution of a contract to which the user is a party, or for the implementation of pre-contractual measures taken at the user’s request (e.g., contact requests via the contact form);
  • for statistical or analytical purposes on aggregated or anonymous data, without the possibility of identifying the user, in order to measure the functioning of the website, traffic, and user interest;
  • to comply with legal obligations to which AF SYSTEM S.R.L. is subject;
  • to ascertain, exercise, or defend a right in court, or whenever judicial authorities exercise their judicial functions.

The legal basis for processing Personal Data for purposes (a), (b), (c), and (d) is the provision of a service or response to an explicit request from the user, which does not require consent under the Applicable Law.
Purpose (d) does not involve the processing of Personal Data, while purposes (e) and (f) represent legitimate processing under the Applicable Law, as once Personal Data are provided, their processing is necessary to comply with a legal obligation to which AF SYSTEM S.R.L. is subject.

Providing Personal Data for the above purposes is optional, but failure to provide them may make it impossible to respond to the user’s request or to comply with legal obligations.

  1. RECIPIENTS

The Personal Data provided by the user may be shared, for the purposes specified in point 3, with:

  • parties necessary for the provision of the services offered by the website, including but not limited to email delivery and website performance analysis, typically acting as data processors for AF SYSTEM S.R.L.;
  • persons authorized by AF SYSTEM S.R.L. to process Personal Data, who are bound by confidentiality or have an adequate legal obligation of confidentiality (e.g., employees and collaborators of AF SYSTEM S.R.L.);
    (points a and b are collectively referred to as the “Recipients”);
  • judicial authorities in the exercise of their functions when required by the Applicable Law.
  1. TRANSFERS

Some of the Personal Data provided by the user may be transferred to Recipients located outside the European Economic Area (EEA).
In such cases, AF SYSTEM S.R.L. ensures that the electronic and paper processing of Personal Data by the Recipients will take place in compliance with the Applicable Law.
These transfers will alternatively be based on an adequacy decision or on the Standard Contractual Clauses approved by the European Commission.

  1. DATA RETENTION

AF SYSTEM S.R.L. will process Personal Data for the time strictly necessary to achieve the purposes indicated in point 3.
Without prejudice to the above, AF SYSTEM S.R.L. will retain Personal Data for the period permitted under Italian law to protect its interests (Articles 2946 and 2947(1)(3) of the Civil Code).

  1. RIGHTS OF THE DATA SUBJECT

Within the limits of the Applicable Law, the user has the right to request from AF SYSTEM S.R.L., at any time, access to their Personal Data, their rectification or erasure, or to object to their processing, as well as to request the restriction of processing or to obtain their data in a structured, commonly used, and machine-readable format.

Pursuant to the Applicable Law, the user also has the right to lodge a complaint with the competent supervisory authority (Garante per la Protezione dei Dati Personali) if they believe that the processing of their Personal Data violates the law.

8. CHANGES

This Privacy Policy has been in effect since July 2018.
AF SYSTEM S.R.L. reserves the right to modify or simply update its content, in whole or in part, also due to changes in the Applicable Law.
AF SYSTEM S.R.L. will inform users of such changes as soon as they are introduced; such changes will be binding once published on the website.
AF SYSTEM S.R.L. therefore invites users to regularly visit this section to be aware of the most recent and updated version of the Privacy Policy and to remain informed about the data collected through the website and how AF SYSTEM S.R.L. uses them.
